General Terms and Conditions of Darako Limited

§1 Applicability to entrepreneurs and definitions

(1) These General Terms and Conditions apply to all deliveries between us and a consumer in the version in force at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).

§2 Formation of the contract and storage of the contract text

(1) The following regulations regarding the conclusion of the contract apply to orders via our online shop https://www.darako.de .

(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order takes place in the following steps:

Before bindingly submitting the order, the consumer can use the “Back” button in their internet browser, after checking their details, to return to the website on which the customer information is recorded and correct any input errors, or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated email (“order confirmation”). With this we accept your offer.

(5) Storage of the contract text for orders via our online shop: We will send you the order data and our general terms and conditions by email. You can view the terms and conditions at any time at https://darako.de/policies/terms-of-service — for security reasons, your order details are no longer accessible via the Internet.

§3 Prices, shipping costs, payment, due date

(1) The prices stated include statutory VAT and other price components. Any applicable shipping costs are added.

(2) The consumer has the option of paying by direct debit, PayPal, credit card (Visa, Mastercard, American Express).

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch. Delivery usually takes place within 4 to 8 business days. In the case of payment in advance, the deadline for delivery begins on the day after the payment order is sent to the bank responsible for the transfer and, for all other payment methods, on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the delivery location, the deadline ends on the next business day.

(2) The risk of accidental loss and accidental deterioration of the item sold, including where the goods are shipped, passes to the buyer only when the goods are handed over to the buyer.

§5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

§6 Right of withdrawal of the customer as a consumer:

Right of withdrawal

You have the right to withdraw from this contract within sixty days without giving any reason. The withdrawal period is sixty days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

To exercise your right of withdrawal, you must inform us (Darako Global Management Limited, Unit 1603, 16/F, The L. Plaza, 367 - 375 Queen's Road Central, Sheung Wan, Hong Kong, info@darako.de‬) by means of a clear statement (e.g. a letter sent by post or an email) about your decision to withdraw from this contract. You can use the attached model withdrawal form, although this is not mandatory.

In order to meet the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will refund to you all payments we have received from you, including delivery costs (with the exception of additional costs arising from return shipping), immediately and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does not apply to the following contracts:

• Contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

§8 Warranty

The statutory warranty regulations apply.

§9 Contract language

The only contractual language available is German.
